Filipino jailed one year for having 3,000 turtle eggs

Sandakan: A 48-year-old Filipino was sent to prison for one year for having 3,000 turtle eggs last week.Kuyuk Lisin admitted before Sessions Court Judge Egusra Ali to committing the offence at 7pm on Nov 13 at the Pemaguan waters here.

Prosecuting officer Abdul Karim Haji Dakog from the Wildlife Department told the court that Kuyuk, who was on pump boat heading from Taganak Island in the Philippines, was stopped by General Operations Force personnel monitoring the waters.

On Kuyuk's boat, they found seven gunny sacks containing the eggs of turtles which are fully protected under the Wildlife Conservation Enactment 1997.

Kuyuk was then referred to the Wildlife Department and was found to not have any written permission by a Minister to be in possession of the turtle eggs.

He had committed an offence under Section 41(1) of the Wildlife Conservation Enactment 1997, which provides for a fine of up to RM50,000 or jail term of up to five years, or both, on conviction.

Kuyuk was ordered referred to the Immigration Department after serving the sentence.

On Nov 13, a local man who had a clouded leopard in Kota Kinabalu was handed the maximum fine amid growing concerns over the illegal sale of protected species by a secret group operating through Facebook.

Prosecuting Officer Augustine Tuuga, who had pressed for a deterrent sentence, told the court that a clear message must be sent to warn the public at large.

Sessions Court Judge Ainul Shahrin Mohamad handed a fine of RM50,000 in default 12 months' jail to self-employed Muhd Rizduan Ibrahim.

Rizduan was found guilty of having the endangered species, which is fully protected under the same enactment,

without written authorisation by a Minister.

He was found having the endangered species at 9.30pm on July 25 this

year at parking lot in front of Kedai Carrificklean, Sulaman Central in Manggatal.

The prosecution has since appealed against the decision to only fine Rizduan and is seeking a custodial sentence with it.
