Causing death: Navy trio to enter defence

Kota Kinabalu: Three navy personnel charged with causing the death of their colleague have been ordered to enter their defence.Sessions Court Judge Ainul Shahrin Mohamad on Tuesday held that the prosecution had raised a prima facie case against the three – Muhammad Zainrudin Nordin, Mohd Hood Mad Hasib, both 26, and Muhammad Fadli Zaini, 25.

Their defence would be heard today (Wednesday) following an application by their counsel for a short time for the defence to form all the questions for a speedy defence proceeding. No objection was raised by the prosecution to the application.

Counsel Ram Singh, who represented the trio, said the defence would be calling four witnesses comprising the three accused and another witness.

The three are accused of causing the drowning death of Able Seaman Asrup Raidin, 27, at 7.36pm on Dec 3, 2013 at the lagoon area of the navy's Station Uniform, Labuan in the South China Sea. They were charged under Section 304 of the Penal Code which carries a jail term of up to 30 years and a fine.

The prosecution had closed its case on Feb 13 after calling 15 witnesses.

Deputy Public Prosecutor Akmazatul Mohamed Nawi prosecuted while counsel PJ Perira is holding a watching brief for Asrup's family.
