Man jailed for assaulting neighbour over flowers

Kota Kinabalu: A 49-year-old man who assaulted his elderly neighbour over a flower fence two years ago was sentenced to three days' jail on Tuesday.Johari Saibaka admitted before Magistrate Jessica Ombou Kakayun to causing hurt to one Dinsah Omar at 9am on Oct 16, 2014 outside a house at Kg Petagas, Putatan.Johari, who was on bail, was ordered to serve the sentence from Tuesday.

Pleading for leniency, Johari told the court that the incident occurred because Dinsah had removed his fence of flowers.He also applied to be placed under a good behaviour bond, saying the injury to the victim was not serious.Jessica rejected his application for a bond on the grounds that he could not take the law into his own hands.Johari had committed an offence under Section 323 of the Penal Code which carries a jail term of up to one year or fine, or both, on conviction.

Meanwhile, a 22-year-old security guard, charged with a similar offence, will go on trial on Sept 8-9.Zul Kasturi Abdul Harun maintained his innocence to assaulting one Ong Chee Gian, 20, with an iron rod, at 8.57am on April 27 in a building at Kolombong.

In another case, 11 men were sentenced for committing drug-related offences.Jenes Tahir, Azman Sham and Malvin Ongkino pleaded guilty to having syabu weighing 2.55gm, 0.06gm and 0.01gm, respectively, between March 17 and June 12.Jenes was fined RM3,400 or 15 months' jail, Azlan was jailed seven months while Malvin was handed six months' jail.The other eight, Samsudin Mohd Nin, Md Zulfadli Sunar, Aslan Karim, Ahmat Jamal, Salleh Md Ali, Delip Tungku, Samidi Omar and Rehan Kulnir confessed to taking drugs at separate locations here in May and June.Samsudin and Ahmat were fined RM1,300 or six months' jail each while the rest were handed six months' jail.Stay up-to-date by following Daily Express’s Telegram channel.
