Death: Navy trio to know fate Aug 30

Kota Kinabalu: Three navy personnel charged with causing the death of their colleague will know their fate on Aug 30.Sessions Court Judge Ainul Shahrin Mohamad set the date for Muhammad Zainrudin Nordin, Mohd Hood Mad Hasib, both 26, and Muhammad Fadli Zaini, 25, when the defence closed its case after calling its last witness, a forensic pathologist.

The trio had given their defence under oath on May 4 and 5 after the court ordered them to enter their defence on the charge.

The three were accused of causing the drowning death of Able Seaman Asrup Raidin, 27, at 7.36pm on Dec 3, 2013 at the lagoon area of the navy's Station Uniform, Labuan in the South China Sea.

The offence under Section 304 of the Penal Code carries a jail term of up to 30 years and a fine.

The accused were represented by counsel Ram Singh while Deputy Public Prosecutor Akmazatul Mohamed Nawi appeared for the prosecution.

In another case, 16 men and six women were charged with entering the State illegally.

However, no plea was taken from them after they were brought before Sessions Court Registrar Richard Isidore.

The foreigners, aged between 20 and 50, were arrested in the city after failing to produce valid documents last week.

They were charged under Section 6(1) of the Immigration Act 1959/1963 which provides for a fine of up to RM10, 000 or a jail term of up to five years or whipping, on conviction.

The court fixed Aug 2 for their plea to be recorded before a Sessions Court Judge.

Pending the date, all the foreigners were ordered remanded further.

Inspector Palani Nathan Aathmanathan appeared for the prosecution.

Meanwhile, in the Magistrate's Court, five people including a juvenile were penalised for taking drugs.

Jonhar Nassal, Kasim Hasbudin, Ansil Paulus, Zahirin Dewin and a 16-year-old Filipino were arrested at separate locations in June.

Jonhar and Ansil were jailed six months, Zahirin was handed eight months, the boy was sentenced to two months' jail, while Kasim was fined RM1,000 or six months' jail.
