Dangerous driving: Filipino has seven summonses, court told

Kota Kinabalu: A 27-year-old Filipino permanent resident, charged with dangerous driving which caused the death of an expectant teacher last month, has seven traffic summonses, including an arrest warrant against him, the Magistrate's Court heard on Friday.Traffic prosecuting officer Inspector Hanif Mamyudi told Magistrate Cindy Mc Juce Balitus that the arrest warrant against the accused, Binji Daih, was issued in 2012 for overloading passengers.

The warrant could not be executed due to a different address used by Binji, said Hanif, responding to a bail application for Binji by his counsel Luke Ressa Balang.

Balang, in applying for a bail, informed the court that a verification from the National Registration Department had been obtained, which confirmed that Binji's MyPR document was genuine.

Balitus, however, denied Binji any bail, ruling that there was an arrest warrant for him.

She set Sept 26-29 for trial.

Binji had on July 18 this year claimed trial to driving a vehicle in a dangerous manner which caused the death of one Suzanne Darlyn Kula @ Anne, 36, who was eight months' pregnant.

The offence allegedly took place at 11.10am on July 16 this year along Jalan Kokol in Manggatal.

Binji was charged under Section 41(1) of the Road Transport Act which carries a jail term of between two years and 10 years and a fine of between RM5,000 and RM20,000 if convicted.

In another case, a 26-year-old local man was jailed 18 months and fined RM2,000 or two months' jail for keeping a stolen motorcycle.

Rayner Alex admitted to having one Chu Kin Fui's motorcycle worth RM3,000 at 4.10pm on Aug 21 at Seri Warisan, Inanam.

Inspector P.Nathan, prosecuting, said Chu had lodged a police report on Aug 20 that a motorcycle belonging to a company which was kept at a store in Damai Plaza had gone missing.

Rayner had committed an offence under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.

Meanwhile, two Filipinos claimed trial to having a fake MyKad and someone else's MyKad.

Rashid Said, 50, is accused of having a fake MyKad bearing the serial number 550211-12-5855 at 10.55am on July 18 along the Penampang By-Pass road.

Kimhar Jul, 32, is alleged to have had one Torsib Abd Hamid's MyKad at the Tanjung Aru police station at 12.30am on Aug 22.

The court set Sept 28 for mention of both cases and ordered Rashid and Kimhar remanded further.
