Drugs: Woman from China on death row fails in appeal

Kota Kinabalu: A 24-year-old woman from China, who was sentenced to death for drug trafficking, failed in her appeal against her conviction and sentence at the Court of Appeal.Justices Dato' Tengku Maimun Tuan Mat, Datuk Dr Prasad Sandosham Abraham and Dato' Zabariah Mohd Yusof unanimously dismissed the appeal by Yu Jing after hearing submissions from her counsel and the prosecution as the respondent.

The court held that it found no reason to disturb the High Court's finding as there were no errors in the trial judge's decision.

Yu Jing was on Oct 15, 2015 found guilty of trafficking 3,492.4gm of syabu at 11.10pm on June 22, 2014 at the Passengers' Examination Unit, Arrival Hall of Terminal 2 in the Kota Kinabalu International Airport.

The offence under Section 39B (1)(a) of the Dangerous Drugs Act carries the death penalty on conviction. Yu Jing's counsel, Ram Singh, had in the appeal raised the issue of no knowledge of the drug and that she was an innocent carrier.

However, Deputy Public Prosecutor Dato Ahmad Kamal Md Shahid rebutted that Yu Jing should have checked everything and that she knew the drugs were in a concealed compartment in the luggage.

Meanwhile, in the Magistrate's Court, an entertainment outlet owner was fined RM5,000 or six months' jail for operating the premises beyond the permitted time.

Ka Chee Chyn, 35, pleaded guilty before Magistrate Jessica Ombou Kakayun to operating the On The Way café at Block C of the Kingfisher Plaza in Inanam over the stipulated time at 1.55am on Oct 20 this year.

He had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which provides for a fine of up to RM5,000 or up to one year's jail or both on conviction. Inspector Azaman Hamat appeared for the prosecution.
