Jail term of six men upped to seven years

Kota Kinabalu: Four local men and two Filipinos who were jailed 11 months each for breaking into a house and stealing bird's nests worth RM300,000 saw their imprisonment sentence enhanced to seven years.High Court Judge Datuk Nurchaya Hj Arshad allowed the prosecution's appeal against the inadequacy of sentence imposed by the Magistrate's Court on Filipinos Mohd Johari Mohd Sulaiman, 50, Basri Keto Ismaiel, 38, and locals Lennon @ Raynold Mahil, 34, Childdanndo Novet K. Gillou, 39, Junaidi Jinap, 39, and Ryzandsyam Sadarin, 27.The court set aside the sentence by the lower court and substituted it with seven years' imprisonment from the date of their arrest.

The six had on May 19, 2016 pleaded guilty at the Magistrate's Court to breaking into a house at Taman Tropicana, Penampang By-pass, in Penampang at 10.47pm on May 1, 2016 and stealing five boxes of processed black bird's nests valued at RM300,000.Deputy Public Prosecutor Aida Fatimah Datuk Abd Jabar submitted that it was a premeditated plan by all the men to break into the house where the amount of loss was RM300,000 and that only some of the bird's nests were recovered as some of them were sold by the men.She appealed for the sentence to be enhanced as the maximum sentence for the offence under Section 457 of the Penal Code is 14 years jail.When asked by the court why their sentence should not be enhanced, the six who were not represented, begged the court to not disturb the sentence.
