Escaping from police custody: 'Ball bearing' rapist jailed, fined

KLANG: An illegal immigrant who escaped police remand has been sentenced to a year in prison and fined RM6,000 for escaping police custody.This was after 23-year-old Indonesian national Rahim Muhamad Pugawan had pleaded guilty to five criminal charges - including rape and robbery - on June 23.

He escaped from the North Klang District Police Headquarters here while in custody on June 19.

Rahim, who had three ball bearings implanted in his penis, had escaped through a window inside the toilet after claiming that he wanted to ease himself.

He fled to Kampung Baru Hicom, Seksyen 26 in Shah Alam but was arrested on June 20 after breaking into a house and attempting to molest a 14-year-old girl.

Deputy Public Prosecutor Syed Farid Syed Ali asked the court to impose a heavier sentence because the accused had brazenly committed additional offences by breaking into a house to steal and attempting to molest a girl while he was on the run.

During mitigation, Rahim, who was not represented, asked for a lower sentence as he had two young children back in his hometown in Madura.

Magistrate Nor Asma Ahmad then sentenced him to a year in prison from the date he was arrested and a RM6,000 fine, or six months' jail in default.

Rahim did not pay the fine.

At the Sessions Court later, Judge Surita Budin set Aug 2 for sentencing for the other offences the accused is charged with.

Rahim pleaded guilty on June 23 to bolting while being remanded and under investigation for an offence under Section 392/379 and Section 376 of the Penal Code. He committed the offence in the Investigation and Detective's Office toilet, at the Criminal Investigation Division, Klang Utara District Police Headquarters here while in the custody of a police constable at around 3.30pm on June 19.

The charge under Section 224 of the Penal Code carries a maximum two years imprisonment or a fine or both, on conviction.

He also admitted to robbing a married couple aged 54 and 53, of a Lenovo tablet and a Samsung mobile phone while armed with a knife, at a house in Bukit Kapar here, about 3.30am on May 27, under Section 392/397 of the Penal Code which carries a maximum 14 years' jail and a fine and whipping on conviction.

He further admitted attacking and threatening the couple's daughter aged 27 years with intention to outrage her modesty at the same place, date and time.

The charge under Section 354 of the Penal Code carries a maximum 10 years imprisonment or with fine or whipping, or any two of the punishments, on conviction.

He also admitted raping the same woman at the same place, date and time, under Section 376(2) of the Penal Code, which carries a minimum 10 years to maximum 30 years imprisonment, on conviction.

Rahim admitted entering Malaysia illegally through Shahpadu Highway Toll Plaza, Bukit Raja here about 4.30pm on June 13, under Section 6(3) of the Immigration Act 1959/63, which carries a maximum RM10,000 fine or five years imprisonment or both and six strokes of the cane, on conviction.
