Acquitted of robbing, causing fear to tourist

Kota Kinabalu: The Sessions Court on Friday discharged and acquitted a 29-year-old security guard on a charge of robbing and causing fear to a tourist from China without his defence being called.Sessions Court Judge Noor Hafizah Mohd Salim freed Mohd Ridzuan Ahmad after ruling that the prosecution had failed to establish a prima facie case against him.

Mohd Ridzuan was accused of robbing one Li Jing of her handbag containing RM60, an ATM card and her China identification card at 7.20am on April 20, this year at a hotel in Penampang.

The offence under Section 392 of the Penal Code carries a jail term of up to 14 years and whipping, on conviction.

About six prosecution witnesses were called during the hearing.

Deputy Public Prosecutor Dinesh Raja conducted the prosecution while counsel Amanda Leonie represented Mohd Ridzuan.

In another case, three men charged with robbing another will go trial on Feb 9-12 next year.

The court set the date for Muhammad Nurfazrie Ashraf Norman, Mohamed Hazri Jumatli and Mohd Salizam Salim who maintained their plea of not guilty.

They are accused of robbing one Mohamad Azrul Jeffry of his bag containing a wallet, an ATM card, RM1,040, a MyKad as well as another sling bag belonging to one Mohd Irfan Haziq.

The crime allegedly took place at 1am on Oct 19, this year at a billiard shop in Pekan Lama Papar.

During the proceedings, the court allowed bail of RM7,000 in two local sureties to Mohamed Hazri who was represented by counsel Azheir Farhan. – Cynthia D Baga
