Passport offence: Filipino jailed

Kota Kinabalu: A 42-year-old Filipino who travelled with a fake endorsement on his passport was fined RM4,000 in default four months' jail.Jacob Aser Daronday pleaded guilty before Sessions Judge Azreena Aziz.

He was found using the passport with fake endorsement at 6.30pm on Nov 9, 2017 at the Domestic Departure Hall of the Kota Kinabalu International Airport.

The offence under Section 56(1)(i) of the Immigration Act 1959/63 provides for a fine of up to RM10,000, a jail term of up to five years, on conviction.

During mitigation, counsel Ram Singh asked for a fine only to be imposed, saying that his client was not aware that the endorsement was fake. Ram told the court that Jacob paid RM500 to an agent in Sandakan to obtain the endorsement.

Meanwhile, Prosecuting Officer Juachim Abel Majain from the Immigration Department urged the court to hand down a deterrent sentence as it was a serious offence.

Meanwhile, 13 men and a woman were jailed between four and five months for entering the State illegally.

Azreena handed the sentence to the foreigners between aged 21 and 45, after they pleaded guilty to charge under Section 6 (1)(c) of the Immigration Act 1959/63.

The court ordered the men, except for the young offenders, to be given a stroke of the cane each.

The foreigners were arrested separately at the city area recently after they failed to produce any valid documents.

During mitigation, some of the foreigners told the court that they had stayed in the State for almost six months.

After completing the jail sentence, the foreigners were ordered to be referred to the Immigration Department.
