PBS calls for calm till court judgement

Kota Kinabalu: Parti Bersatu Sabah (PBS) urged Sabahans to refrain from harsh words and hurling invectives at each other over the issue of who the rightful Chief Minister is or should be."We cannot turn back the clock on whatever transpired after the general election.

The fact is Tan Sri Datuk Seri Panglima Musa Haji Aman was lawfully sworn in by TYT the Governor as Chief Minister on 10 May at Istana Negeri as Chief Minister when he was able to show he had the support of 31 elected assemblymen, two from Star and 29 from BN. Whatever transpired after that is another matter," said PBS Secretary General, Datuk Johnny Mositun.

Subsequent to his swearing-in as Chief Minister, Musa was shocked to be informed by the Governor's Office two days later that he was no longer the Chief Minister and that the Governor had sworn in Datuk Seri Shafie Apdal of Parti Warisan Sabah as Chief Minister as Musa had lost majority support with the defection of Upko from BN to Shafie's Party Warisan Sabah.

"Musa is right in law to insist he is the legitimate Chief Minister. There is no provision in our State Constitution for him to be removed from office in this manner. The proper way for his removal is by a vote of no-confidence in the State Assembly. It is as the Karanaan assemblyman, Datuk Seri Masidi Manjun stated earlier," Mositun said.

Masidi, who was Minister of Tourism and Culture in the previous state cabinet, had also made the same observation.

"I agree with Masidi. It is a matter of law and not poilitics. The law must be upheld without fear or favour, as the newly-appointed Prime Minister himself has pledged," Mositun said.

Musa has filed a suit against the Governor, Tun Juhar Mahiruddin, for swearing in Shafie as Chief Minister, claiming that he (Musa) remains the rightful Chief Minister till he resigns or loses the majority support in the state Assembly.

"Since Tan Sri Musa has filed a suit over this matter, it is my view that all parties should wait for the outcome.

I am informed the case will come up for hearing early July," Mositun said.
