Court sets Oct 8-12 for defence of inspector on murder charge

Kota Kinabalu: The High Court fixed Oct 8-12 for the defence of a police inspector charged with the murder of a single mother in Keningau seven years ago.Deputy Registrar Dana Arabi Wazani set the date for Ahmad Rizal Umar during mention of his case on Wednesday.Rizal, 33, was accused of murdering one Kartini Borhan, 27, between 4am and 5am on Sept 29, 2011 in a house at Taman Adika in Keningau, an offence under Section 302 of the Penal Code which carries the death sentence on conviction.

The charge under Section 302 of the Penal Code carries the death sentence on conviction.Initially, Rizal was on discharged and acquitted of the charge by the High Court here on July 22, 2014 without his defence being called.However, the Federal Court on March 22 this year overturned his acquittal and ordered him to enter his defence to the charge after allowing the prosecution's appeal against his acquittal.Rizal's counsel said they have six witnesses to testify in his defence.

Deputy Public Prosecutor Wan Farrah Farriza Wan Ghazali appeared for the prosecution while Rizal was represented by counsel Ram Singh, Rizwandean Borhan, Kimberly Ye and Aaron Mah.Rizal was ordered be remanded further pending the dates as the charge against him has no provision for bail. - Jo Ann Mool
