Warisan candidate's bid  to unseat Kiulu rep fails
Kota Kinabalu: The Election Court here on Friday struck out a petition by Parti Warisan Sabah candidate Joanna Sue Henley Rampas (pic) to nullify the result of Kiulu state seat in the 14th General Election.With the decision, Parti Bersatu Sabah's Datuk Joniston Bangkuai who contested under the Barisan Nasional (BN) ticket will keep the seat.

Sibu-based High Court Judge Supang Lian allowed Bangkuai's preliminary objection application to strike out the petition filed against him with costs of RM20,000.

The decision were delivered in Supang's chamber.

Counsel Tengku Fuad Tengku Ahmad, representing Joniston, told the media after the proceedings that the court held, among others, that the petitioner had failed to serve the petition in accordance with the Election Petition Rules and that the petitioner had also failed to state the advance polling dates.

"Polling occurred on May 5 and May 9. May 5 was advance polling and May 9 was general polling. The Election Petition Rules requires you to state both dates and the petitioner had failed to do so.

"There were a few other grounds that were considered but all in all, the petition was struck out with costs of RM20,000," said Tengku Fuad.

In her petition filed on June 18, Rampas named Bangkuai as the first respondent, with the returning officer and Election (EC) Commission as second and third respondents respectively.

In the election, Bangkuai retained the seat after polling 4,336 votes against the 2,893 for Rampas.

The Election Court has, so far, struck out seven election petitions - six filed by Warisan for Sungai Sibuga, Libaran, Sook and Kundasang state seats as well as Sipitang and Keningau parliamentary seats, and one filed by Sabah Parti Keadilan Rakyat (PKR) for Pensiangan parliamentary seat. - Jo Ann Mool
