THE Immigration Department in Sabah will take legal action against employers who failed to register their illegal workers during the just-ended 5P registration exercise from July 18 to Aug 10.Apart from that, employers who do not ensure their illegal workers who registered under the exercise return home would also be charged under the same Act for harbouring illegals.

Its Director Mohd bin Mentek said these errant employers would be charged in court with harbouring illegals under the Immigration Act.

"They would be charged under Section 56(1)(d) of the Immigration Act 1959/63 which carries a fine of between RM10,000 and RM50,000 for each illegal.

"And if there are more than five illegals involved, then the employer is liable to a jail term of between six months and five years, and whipping, upon conviction," he said.

According to him, there will be no more extension of the registration exercise in Sabah although the 6P Programme in the peninsula has been extended.

"We have given 24 days for the employers to inform their illegal workers to register. Publicity on the exercise under the 5P programme was made widely known in the print and electronic media almost everyday.

"Not knowing about the registration exercise or not reading the newspaper is not an excuse and unacceptable. Enough is enough as we have given ample time for them to do so and we have carried out measures to facilitate them like setting up nine registration centres and having our mobile unit go to the plantations in Sabah under the Outreach Programme.

"Now they have to face the music as no one will be spared because we are very serious and committed in addressing this perennial issue in the State," he said.

He stated that the official number of illegals in Sabah who registered during the 5P exercise was 161,370 comprising 115,046 Indonesians, 45,894 Filipinos and 430 illegals of other nationalities, including a family of seven Singaporeans who had overstayed here for almost 20 years.
