Killing her new-born and dumping into bin: Girl jailed

Keningau: A 20-year-old local shop assistant, who smothered her new born and dumped the body into a garbage bin six months ago, was sentenced to 18 months' jail by the Magistrate's Court here.The girl pleaded guilty before High Deputy Registrar Zaini Fishir, who sat as a Magistrate, to throwing the baby after delivering him inside a toilet at 12.50pm on May 4 this year at the garbage dumping area in Sook.

She committed the offence under Section 318 of the Penal Code which provides for a jail term of up to two years or a fine, or both, on conviction.

Before the court meted out the sentence, the woman applied for leniency saying she regretted her act and promised, not to commit the crime in future.

She also hoped the court could give her a chance to change her life.

The girl also confessed that the baby was born as a result of an affair she had with her foreign boyfriend since early February 2010.

However, Prosecuting Officer, Chief Inspector Ramona Albert urged the court to impose a deterrent sentence on the grounds that baby dumping cases among the teenagers are worrying nowadays.

"The woman had committed an inhuman act Éthe court should impose a sentence which will serve as a lesson to others," she said.

In tendering the facts of the case, Ramona said the woman was pregnant for more than seven months without the knowledge of her employer and family.

She said on the said day the woman had locked herself inside a toilet in a shop after feeling unwell and gave birth there.

She then placed the baby on the floor but fearing the baby's cries will be heard by several employees in the shop who knocked on the toilet door, she decided to cover the infant's nose and mouth with her hands and this caused the baby to die.

The woman than managed to get a plastic bag from her sister, who was waiting in line to use the toilet and put the body inside the plastic bag before cleaning the bloodstains on the floor.

She then dumped the plastic bag containing the body into a garbage bin but a witness saw bloodstains on the woman's pants as well as smelled the strong odour in the toilet used by the woman.

Suspecting something amiss, the witness scoured the trash bin and found a black plastic bag containing the body of a baby boy and reported it to the police, who then arrested the woman the same day.

The body of the baby was referred to the Queen Elizabeth Hospital in Kota Kinabalu for post mortem and a forensic pathologist concluded that the baby was born alive and normal.

Ramona said the infant's death was caused by restrictions on the nose and mouth (asphyxia due to smothering) and also that the baby suffered broken ribs and injuries in several areas of his face and body.
