Riduan's appeal adjourned to Oct 23

KOTA KINABALU: The High Court adjourned to Oct 23 the appeal by a former restaurant manager against his conviction and sentence of 12 years' imprisonment and two lashes of the cane for raping a 13-year-old schoolgirl who he subsequently married.High Court Judge Chew Soo Ho set the date following a request for time from Riduan Masmud's counsel as well as the prosecution to reply each other's submissions on the appeals.

The prosecution is also cross-appealing against the inadequacy of the sentence imposed.

Riduan was on Feb 3 this year found guilty by the Sessions Court of committing the crime inside a car parked by the side of the road towards the Kionsom Waterfall in Inanam between 9am and 10am on Feb 18, 2013.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping.

He, however, managed to obtain a stay of execution of the sentence pending an appeal to the High Court.

Deputy Public Prosecutor (DPP) Effizah Ernie Idris appeared for the prosecution while counsel Ram Singh represented Riduan.

Meanwhile, the case of a 42-year-old Filipino charged with murdering his wife has been postponed to Oct 27.

Murphy Sakkam Alah's newly assigned counsel Hamid Ismail applied for an adjournment to write a representation letter to the Deputy Public Prosecutor's office to reduce the charge.

Murphy had, on Aug 27, claimed trial to the murder of one Saring Tanghao, 45, at 9.30am on Aug 21, 2013 at the workers' house in the Kg Ganang construction site along Jalan Pahlawan, near here.

He is charged under Section 302 of the Penal Code which carries the death sentence on conviction.

DPP Ahmad Nazneen Zulkifli prosecuted.
