KOTA KINABALU: A 40-year-old self-employed man was fined RM1,000 or three months' jail for slapping an elderly woman. Au Sin Vui pleaded guilty before Magistrate Stephanie Sherron Abbie to voluntarily causing hurt to one Chong Fung Moi, 61, at 3.20am on Oct 22 in front of a house at Taman Richdar, in Menggatal.

Chief Inspector Lim Swee Beng, prosecuting, told the court that Chong, a trader, had asked Au, who had parked his vehicle by the roadside, to move his car away as it was blocking her from reversing her car out of her house.

However, Au became angry and kicked the left door of Chong's van and hit her face.

Au confessed to slapping Chong on the grounds that she spoke to him rudely.

He was charged under Section 323 of the Penal Code, which carries a jail term of up to one year or fine of up to RM2,000, or both, if convicted.

In another court, Magistrate Mohd Faiz Omar gave a discharge not amounting to an acquittal (DNAA) to a 38-year-old woman charged with cheating.

The court made the decision on the case of Dg Sariah Ratman after the complainant told the court that she was not interested to proceed with the case.

Sariah, a housewife, was accused of cheating a Filipina Visaya, Noralyn Ople, to be her business partner in supplying camping tents to schools in Sabah and had asked RM3,500 from Noralyn to start the business and another RM2,000 to manage Noralyn's application for a Permanent Resident card.

The offence allegedly took place at noon on July 21 at the McDonald's restaurant in Centre Point Sabah.

Inspector Syahrin Ali prosecuted.
