11-year-old discloses rape during lesson about sex

KOTA KINABALU: A 50-year-old local farmer who raped his 11-year-old stepdaughter will have gone unpunished had she not opened up during a lesson about sex to her teacher at school.

The teacher immediately informed the victim’s mother who lodged a report. The culprit was jailed 27 years by Sessions Court Judge Noor Hafizah Mohd Salim, Thursday.

He raped the pupil between 7pm and midnight at a house in Tenggilan, Tamparuli in February, this year. Further investigations revealed that the man had been raping her since she was in Primary Five but that she was afraid to tell her mother about it.

The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years and whipping, on conviction.

Meanwhile, a 30-year-old was jailed 13 years and ordered given two strokes of the cane for raping a 13-year-old girl.

Muslimin Lamusa pleaded guilty before Noor Hafizah to raping the girl between 5am and 6am at a rented house in Tuaran on Sept. 2, last year.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

Counsel Goldam Hamid who defended Muslimin asked for leniency saying he has family to look after.

The court heard that the victim lodged a report on Sept 4, 2018 claiming she was raped by a man identified as Muslimin.

Investigation disclosed that on Sept 2, 2018, the victim and her four friends escaped from a hostel in Tuaran to meet one Boby, who then brought them to Tuaran town. After arriving at the town, the victim and her friends then met Muslimin at a pub where they were drinking.

At about 5am, Muslimin brought the victim to the rented house near the pub where she was raped. According to the victim, she was half-conscious from the drinks when raped by Muslimin.
