Grab driver’s murder: 2 charged
Kota Kinabalu: A Filipino and a local were charged in the Magistrate’s Court in Tuaran with the murder of a Grab driver three weeks ago.

Car wash workers, Filipino Arsit Indanan, 20, and local Amru Al Asy Japri, 24, were brought before Magistrate Jessica Ombou Kakayun at the Mobile Court on Monday.

They allegedly murdered one Mohammad Hanafiee Jaffar, 27, inside a Proton Saga FLX car between 4am and 5am on May 25 at the roadside of Jalan Marabahai, in Tuaran.

No plea was taken from Arsit and Amru after the charge under Section 302 of the Penal Code was read to them.

They face the death penalty if convicted.

Jessica set July 11 for mention of the case in Tuaran.

Both Arsit and Amru were ordered to be remanded further as the charge framed against them has no provision for bail.

Earlier, counsel Dominic Chew, who represented Amru, applied for him to be referred to the Hospital Mesra in Bukit Padang to check whether he is fit to enter a plea.

Chew, in applying so under Section 342 of the Criminal Procedure Code, told the court that Amru had previously received treatment at the said psychiatric hospital.

Prosecuting officer Inspector Papilus Primus objected to the application.

Magistrate Jessica held that the court would consider Chew’s request in the event that he could show proof to the court of Amru’s hospital review appointment card on his hospital visits.

Together with Chew in representing Amru was counsel Aida Jaafar Mad Ariff.

Arsit was not represented.
