Kota Kinabalu: A jobless and paperless Filipino was sentenced to a total of five years and three months’ jail by the Sessions Court here Thursday on two counts of having a dangerous weapon in public and staying in the State illegally.

Gavier Jipry, 28, pleaded guilty before Judge Azreena Aziz to committing the offences at 4.20pm on Aug 17 at the Petron kiosk in Kg Air.

He was jailed five years for having a 21 cm length of knife without a reasonable reasons and was handed another three months on the second count of entering the State illegally.
Earlier, the court was informed by the prosecution that Gavier was arrested by police after a tip–off following a report lodged by a man that a man tried to rob him outside a restaurant at Gaya Street two days before.

The police found the knife in Gavier’s pocket and that Gavier failed to produce his identification document when asked by the police to do so, said Deputy Public Prosecutor (DPP) Megat Mahathir Megat Tharih Afendi.

During mitigation, Gavier, who was unrepresented, said he had been in the State for a year.

The prosecution applied for a deterrent sentence.

The first count under Section 6(1) of the Corrosive Explosive and Dangerous Weapon 1958 carries a jail term of between five years and 10 years and whipping on conviction, while the second count under Section 6(1)(c) of the Immigration Act 1959/63 provides for a jail term of up to five years, or a fine of up to RM10,000, on conviction.

The court ordered Gavier to serve the jail terms from the date of his arrest.

Meanwhile, in the Magistrate’s Court, Gavier was charged with taking drug.

No plea was taken from Gavier, who was brought before Magistrate Afiq Agoes, pending the chemist’s report.

The court set Oct 5 for e-Review and offered no bail to Gavier as he has no valid identification document.

Inspector Lim Swee Beng prosecuted.
