Kota Kinabalu: A 39-year-old man was ordered to enter his defence on a charge of raping his daughter.
Sessions Court Judge Azreena Aziz came out with the decision for the man after ruling that the prosecution had succeeded in establishing a prima facie case against the man.
The court set Sept 22–23 for the man’s defence.
The man is accused of committing incest against the 12-year and six-month-old girl between 7am and 10am on Aug 11, 2019 at a house in Sipitang.
The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes of the cane, on conviction.
During the hearing at the prosecution stage, about seven witnesses were called to testify.
Deputy Public Prosecutor Siti Amirah Muhammad Ali conducted the prosecution while counsel Henry Gudid defended the man.
