Kota Kinabalu: A 37-year-old who assaulted his wife was jailed two years and fined RM3,000 or six months’ jail.
Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to Mohd Kadir Imbat who changed his plea and admitted to the charge against him when his case was brought up for case management.
Mohd Kadir caused hurt to his 31-year-old wife by using his hands, an iron rod and a broom at noon on Aug 25, this year at a house in Kg Kuala Mandahan, Papar.
The offence, under Section 324 of the Penal Code and punishable under Section 326A of the same Code, provides for a jail term of up to 20 years and liable to fine, or whipping, on conviction.
During mitigation, Mohd Kadir who was not represented asked for leniency, saying he was very remorseful.
He told the court that it was his first offence and that it happened because he could not control his emotions.
He also said he has to care for his mother who needs to undergo dialysis treatment and also look after his family.
However, Deputy Public Prosecutor Megat Mahathir Megat Tharih Affendy urged the court to impose a deterrent sentence on the grounds that the case was a domestic violence as the victim is the wife.
He submitted that the wife suffered injuries in the incident.
The court ordered Mohd Kadir to serve the jail sentence from the date of his arrest.
The incident occurred when the victim was peeling anchovies and at the same time cooking porridge, requested by Mohd Kadir.
When she served the porridge, Mohd Kadir questioned the wife why there was no other side dishes, to which the victim replied that she did not have money to buy items because he did not give her money.
Hearing the words, Mohd Kadir became angry and cursed the victim, which resulted in an argument between them.
Mohd Kadir then slapped and punched the victim’s mouth because he felt the victim had resisted his words and was rude to him.
He then took an iron rod and hit the victim’s hand before throwing the iron towards her, but luckily she managed to avoid it.
After that, Mohd Kadir took a broom and hit her back before she ran to a neighbour’s house to seek help.
Mohd Kadir was arrested following a police report lodged by the wife.
