Fine, jail for robbing handphone from tourist

Kota Kinabalu: A 30-year-old man was jailed five years and fined RM3,000 in default three months’ jail for robbing a handphone from a China national tourist.

Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to Jimmy Abdul Rahim who changed his plea and admitted to the charge against him during the first day of his trial. Jimmy had the female tourist of her handphone at 7.15pm on Dec 30, 2019 at Taman Prince Philip, Pantai 2, Tanjung Aru, here. The offence under Section 392 of the Penal Code carries a jail term of up to 14 days, and whipping, on conviction.

In meting out the sentence, the court said she had taken into consideration the seriousness of the offence, the accused has no previous conviction and he was the first offender.

During mitigation, counsel Mohd Luqman Syazman Zabidi asked for leniency saying that Jimmy who is a IMM13 holder, has to look after his ageing mother and his two children.

He added that prior to the incident, the mother was taken care by his fiancé but she had since left Jimmy for another man. Mohd Luqman also highlighted that Jimmy was a first time offender and had pleaded guilty to his offence. However, Deputy Public Prosecutor, Megat Mahathir Megat Tharih Affendy urged the court to impose a deterrent sentence.
