Kota Kinabalu: A 29-year-old jobless man was charged with having 46.36gm of syabu and taking the drug repeatedly.
Mohd Shafiin Hifzan Kasmurih was brought before High Court Deputy Registrar Cindy Mc Juce who sat as a Sessions Court Judge, to face the charge against him, Thursday.
However, no plea was taken from Mohd Shafiin as the chemist’s reports on the drugs are still pending.
On the first count, Mohd Shafiin is accused of having the drug at 2.10pm on Oct 1, this year at a house in Kg Lumat, Beaufort.
The offence under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 39A(2)(r) of the same Act which provides for a jail term of between five years and life imprisonment, and whipping at least 10 strokes of the cane, upon conviction.
On the second count, he allegedly took the drug on the same day also in Beaufort.
He has two previous convictions for taking syabu.
The court set Nov 2 for mention the cases and ordered Mohd Shafiin to be remanded further pending the date.
Deputy Public Prosecutor Mas Izzaty Lokman appeared for the prosecution while Mohd Shafiin was not represented.
