Jail, fine for keeping stolen car

Kota Kinabalu: A 31-year-old man was jailed five days and fined RM100 or three days jail by the Magistrate’s Court here Tuesday for having a car believed to be stolen.

Unemployed Lius Raja pleaded guilty before Magistrate Lovely Natasha Charles to keeping a Proton Saga Aeroback car, which he failed to give satisfactory explanation on how he obtained it at 12.30pm on Oct 14 this year at Jalan Sapi Nangoh in Beluran.

The offence under Section 22A (1) of the Minor Offences Ordinance provides for a fine of up to RM100 or up to three months jail or both on conviction.

The prosecution in presenting the facts of the case told the court that the car had been reported missing by its owner on Jan 11, 2015 and that the car, which was parked near the Our Lady Queen of Peace in Kobusak, Penampang was suspected to be stolen.

Duty counsel Lim Ming Zoong @ Lawrence representing Lius applied for a lower fine by submitting that the Kepayan prison is currently placed under Enhanced Movement Control Order (EMCO) and that Lius been under remand since he was arrested.

Lim also informed the court that Lius, who used to work as oil palm tree cutter, was not aware that the car was stolen when he purchased it and that the car’s value was RM3,000 when he bought it.

Inspector Albert Basiri, prosecuting, applied for an adequate sentence.

The court ordered Lius to serve the jail sentence from the date of his arrest on Oct 14.

Meanwhile, the case of five people charged with committing various drug-related offences has been rescheduled.

Four of the people were charged with taking syabu as framed under Section 15(1)(a) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM5,000 or up to two years jail on conviction.

Another accused was charged with having syabu as framed under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both on conviction.

The chemist’s reports of four of the accused were not ready and the court set Nov 4 for further e-Review.

One of them has their chemist’s report ready but the court rescheduled the case to Nov 16 for hearing.
