Kota Kinabalu: The Magistrate’s Court here sentenced a construction worker to eight months’ jail for threatening to cause death to his wife last month.
Nasir Abih, 39, changed his plea and pleaded guilty to committing the offence against his 36-year-old wife at 11am on Oct 19 in a house at Kg Pondo, Pulau Gaya.
Nasir was on Monday pleaded not guilty to the charge under Section 506 of the Penal Code which carries a jail term of up to seven years or fine or both on conviction.
He was ordered to serve the jail term from the date of arrest his arrest on Oct 27.
Earlier, the prosecution in tendering the facts of the case told the court that Nasir’s wife lodged a police report on Oct 19 by stating that she had been threatened by Nasir which frightened her.
Nasir, who was not represented, requested for a lenient sentence by saying that he has no intention to hurt his wife and that he was remorseful of his action.
Nasir confessed that it was his mistake and said that the incident stemmed from a small matter, where he had used the RM200 cash which caused his wife nagging which led to an argument between them and that what he had said in the argument was a slip of the tongue.
Nasir said he was never hit his wife throughout their marriage and that he still loves his wife.
The prosecution applied for an adequate sentence.
In another case, a 24-year-old porter claimed trial to two counts of burglary and trespassing.
Mohd Noraseh Norazam was accused of breaking into the Saloon 57 Top Image premises at Warisan Square here and stealing RM74 from the cash box in the premises at 3.25am on Oct 13.
The charge under Section 457 of the Penal Code carries a jail term of up to 14 years and liability of a fine on conviction.
On the second count, Noraseh allegedly trespassing into the ground floor, Block D of the Warisan Square at 12.10am on Oct 19.
The offence under Section 448 of the Penal Code carries a jail term of up to three years or fine of up to RM5,000 or both on conviction.
The prosecution in applying for another mention date, proposed bail at RM3,000 in two sureties on each charge.
Duty counsel Lim Ming Zoong @ Lawrence representing Noraseh, applied for a lower bail on the grounds that he could not gather sufficient money during the current CMCO by working as a porter in Segama area as he only earned RM50 per day depending on how much goods he carried.
The court fixed Dec 17 and Dec 2 for mention of the first and second count, respectively and released Noraseh on a bail of RM1,000 undeposited in two sureties on each charge.
