Kota Kinabalu: The case of five people charged with trafficking 210.33gm of syabu has been adjourned to Dec 3.
The five’s case was set for mention at the Magistrate’s Court here but has been rescheduled due to the Conditional Movement Control Order (CMCO).
Johaniskin Nawir, 41, Mansur Baba, 39, Ismail Mading, 27, Muhajra Hajaruddin, 22, and Lalusa Maamor, 42, were accused of committing the offence at 3pm on Sept 13, in a unit at Block G, University Utama Condominium, Telipok.
They were first produced in court on Sept 25 but no plea was recorded from them after the charge was read out to them.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act, carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The five were ordered to be further remanded pending the date.
Meanwhile, the court set Nov 10 for mention of the case of a 25-year-old man, who is facing a charge under Section 22 (b) of the Prevention and Control of Infectious Diseases Act 1988.
The court fixed the date for Asmil Tito as he was at the central lockup in Kepayan.
Asmil was on Nov 4 jailed a total of 17 months by the Magistrate’s Court on two counts of trespassing and having stolen items believed to be stolen.
Meanwhile, the sentencing of a 27-year-old man charged with taking syabu for the third time had been re-scheduled.
Sessions Court Judge Elsie Primus set Nov 30 for Mohd Nazri Jaired’s sentencing in view of the implementation of Conditional Movement Control Order(CMCO) in the State.
The CMCO was implemented from Oct 8 this year to prevent the spread of Covid-19.
Mohd Nazri is accused of taking the drug for the third time in Kota Belud on Jan 9, this year.
The offence under Section 15(1)(a) of the Dangerous Drugs Act read with Section 39C(1) of the same Act provides for a jail term of between five years and seven years and whipping of not more than three strokes, upon conviction.
Meanwhile, the same court vacated the trial of a 38-year-old man also charged with taking syabu.
The new trial date for Jasry Jembri will be fixed on Dec 2 which was set for mention for pre-trial case management.
The order was made also in view of the CMCO.
Jasry allegedly took the drug at 9.30am on Feb 4 this year also in Kota Belud.
The charge stated that he has two previous convictions for taking syabu.
