Kota Kinabalu: A 37-year-old Filipino who was previously sentenced to three months’ jail for illegal entry, was jailed another three months for having other’s MyKad.

Magistrate Lovely Natasha Charles meted out the sentence to Alwadan Burhan who pleaded guilty.

Alwadan was found having the MyKad bearing the serial number 760225-12-5827 under the name Ashil Billahi at 3.50pm on Nov 6 this year at Sulaman Sentral in Jalan Sepanggar, near here.

The offence under Section 25 (1) (o) of the National Registration Regulations 1990 provides for a jail term of up to three years, or fine of between RM3,000 and RM20,000, or both, upon conviction.

In seeking for leniency, Alwadan said he has two children who are currently with his wife in the Philippines.

He claimed that he found the document and used it to find job.

However, Inspector Lim Swee Beng urged the court to hand a suitable sentence.

The court heard that Alwadan was detained by police during the Ops Covid-19 conducted at the area.

Alwadan who was behaving in a suspicious manner, was asked to produce his document and later he gave the MyKad which was later was found not belonged to Alwadan.

Further investigation revealed that the rightful owner of the document had lost his document two years ago.

After completing his jail sentence, Alwadan was ordered referred to the Immigration Department for deportation.
