Kota Kinabalu: A 40-year-old man was sentenced to a total of 38 months’ jail for keeping stolen items and failing to give a reasonable explanation on how he got several items believed to be stolen.
Magistrate Jessica Ombou Kakayun meted out the sentence to Sutresno Intu, who pleaded guilty to the charge against him, on Thursday.
On the first count, Sutresno was sentenced to 36 months for having the stolen items namely, a unit of a projector and a digital camera at 5.50pm on Nov 26 this year at the Silverstone workers’ quarters in Penampang.
The offence under Section 411 of the Penal Code carries a jail term of up to five years, or fine, or both, on conviction.
On the second count, he was handed another two months’ jail for failing to explain how he got the items such as a handphone, a receipt, a black box, four pairs of rings and a necklace which believed to be stolen items.
He committed the offence at the same place and time.
The court ordered Sutresno to serve the jail sentence concurrently from the date of his arrest.
During mitigation, counsel Lawrence Lim from the National Legal Aid Foundation who represented Sutresno, asked for leniency saying that his client was working as a mechanic and earning about RM1,400 per month.
Lim informed the court that Sutresno has two children and a wife to look after.
However, Inspector Albert Basiri urged the court to impose an appropriate sentence.
