Kota Kinabalu: A 37-year-old jobless man was sentenced to a total of 24 months’ jail for trespassing a rented room and having stolen items.
Magistrate Stephanie Sheron Abbie handed the sentence to Mohd Sapie Basir @ Bangsawan, who pleaded guilty to two charges against him, on Friday.
On the first count, Mohd Sapie was jailed 14 months for breaking into the rented room in Happy Muslim Restoran, here, between 11am and 11.05am on Nov 10 this year.
The offence under Section 457 of the Penal Code carries a jail term of up to 14 years, on conviction.
On the second count, he was sent to prison for another 10 months for having 14 stolen items namely, 10 bags, three boxes containing nail colour and a wallet at 1.50pm on Nov 16 this year by the roadside in Kompleks Sinsuran, here.
The court ordered Mohd Sapie to serve the jail sentence from the date of his arrest.
During mitigation, Counsel Lawrence Lim from the National Legal Aid Foundation who represented Mohd Sapie, asked for a light sentence saying that his client has two children aged four and 10.
Lim informed the court that Mohd Sapie was a first offender and that a lower sentence must be handed down on him.
He also applied for the sentence of the charges to be run concurrently.
Inspector Suzie Kupit urged the court to impose a deterrent sentence.
