Kota Kinabalu: A 37-year-old man, charged with raping his 13-year-old daughter two years ago, was ordered to enter his defence to the charge.
Sessions Court Judge Elsie Primus who made the order on Thursday said that the court was satisfied that the prosecution had proved a prima facie case against the man.
Elsie set Jan 25-26, next year for the man’s defence.
The man was accused of committing the crime at 9am on April 7, 2018 in a house in Penampang.
He was charged under Section 376(3) of the Penal Code, which carries a jail term of between eight years and 30 years and whipping of not less than 10 times.
Counsel Dato Sri Rakhbir Singh, who represented the man, informed the court that the defence probably has three witnesses.
The prosecution had called nine witnesses throughout the prosecution stage.
Deputy Public Prosecutor Mas Izzaty Lokman prosecuted.
