Kota Kinabalu: The case of 33 politicians led by former Chief Minister Tan Sri Musa Aman filing a court action over the July 30 dissolution of the State Assembly by the Head of State gripped the State for major part of the year.The politicians had on Aug 6 filed an application for leave to commence judicial review to challenge Tun Juhar Mahiruddin’s decision, which paved the way for a snap state election.
They named Juhar, caretaker Chief Minister Datuk Seri Mohd Shafie Apdal, the Election Commission and the State Government as the first, second, third and fourth respondents, respectively.
In their leave applications, the 33 politicians argued that there was improper advice for Juhar to dissolve the State Legislative Assembly under Article 21 (2) of the State Constitution.
