Kota Kinabalu: A 45-year-old trader was fined RM5,000 or three months’ jail by the Sessions Court here for selling 91 units of razors that were falsely branded as Gillette Nacet II.
James Yong Kui Seng pleaded guilty before Judge Elsie Primus to selling the fake razors, for trading purposes, to Chua Soon Seng Mini Market Sdn Bhd at Donggongon new township in Penampang on Aug 18, 2020.
Yong was charged under Section 102 (1) (b) of the Trademarks Act 2019 which is punishable under Section 102(1)(b)(ii) of the same Act that carries a maximum fine of RM10,000 for each item or imprisonment of up to three years, or both, if convicted.
Unrepresented, Yong requested for a lenient sentence by telling the court that he only took three strips of the items and sent them to Donggongon.
The prosecution from the Domestic Trade and Consumer Affairs Ministry (KPDNHEP) left to the court for the sentencing.
The prosecution also applied for the fake items to be returned to the prosecution for disposal.
