Kota Kinabalu: A 63-year-old man was jailed eight years and given six strokes of the cane for committing sexual abuse against his seven-year-old granddaughter.Sessions Court Judge Elsie Primus handed the sentence to the man who pleaded guilty to the charge against him on Monday.
The man committed the offence against the minor at 8.30pm on Jan 23, 2020 in a house in Kota Belud.
The offence under Section 14 of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.
The court ordered the man to serve the jail sentence from the date of his arrest.
During mitigation, the man who was not represented asked for leniency saying that he is already old and that he is unemployed.
However, Deputy Public Prosecutor Mas Izzaty Lokman urged the court to impose a deterrent sentence on the grounds that the victim who is only seven years old, is the man’s granddaughter.
Mas submitted that the man should protect the victim instead of committing such offence.
The court heard that the incident came to light when the victim’s auntie showed a video about the man’s act against the victim.
The victim’s father then lodged a police report against the man who was arrested later by the police.
