Kota Kinabalu: A company was fined RM2,500 for having for sale unregistered products.
Sessions Court Judge Azreena Aziz meted out the sentence to Borneo Recipe Sdn Bhd after its representative pleaded guilty to the charge against the company.
The company was found having two types of unregistered products, namely nine bottles of Sabah Noni Oil and eight boxes of Noni Natural Soap.
The offence took place at 11am on May 21, 2019 at the company shop in Suria Sabah, here.
The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984, carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.
During mitigation, the representative asked for leniency, saying the company had suffered a lot due to the Covid-19 following the implementation of the Movement Control Order and many of its branches had been closed.
However, Prosecuting Officer from the Pharmacy Department, Muhammad Hafifi Zainal Abidin, urged the court to impose a deterrent sentence on the grounds that the products were not registered with the Health Ministry.
Muhammad submitted that as a trader, the company should ensure all the products they have complied with the specification standard set by the Ministry.
