Sexual abuse: Woman, cousin charged

Kota Kinabalu: A woman and her cousin were charged with two counts of committing sexual abuse against the woman’s sons and will have their case management on March 17.

Sessions Court Judge Elsie Primus set the date for the woman and man, aged 29 and 31.

Both of their cases are to be consolidated.

On the first count, the duo allegedly touched the private part of the four-year-and-one month-old boy at a house in Penampang during the daytime between September 1, 2018 and October 17, 2020.

On the second count, the duo were accused of touching the private part of another boy aged five years and seven months at the same place and between the same day. The offence under Section 14 of the Sexual Offences Against Children Act 2017 and read together with Section 34 of the Penal Code which provides for a jail term of up to 20 years, and whipping, upon conviction.

Deputy Public Prosecutor Syarifuddin Abdul Rassa appeared for the prosecution while counsel Batholomew Jingulam defended the duo.

Counsel Ram Singh and Kimberly Ye held a watching brief for the boys and their biological father.

Meanwhile, a 40-year-old man charged with trafficking 17,509.4gm of syabu will go on trial on March 8-12.

High Court Judicial Commissioner Wong Siong Tung set the date for Chew En Leong when his case was brought up to fix the trial date.

Car wash owner Chew had on Oct 3, 2019 pleaded not guilty to committing the offence at 6.50pm on Dec 21, 2018 at the five-foot-way in front of the ABX Express (M) Sdn Bhd premises at Gaya Street here.

Chew was charged under Section 39B(1)(a) of the Dangerous Drugs Act which carries the death sentence or imprisonment for life, and whipping of not less than 15 strokes if not sentenced to death, upon conviction.

Pending the date, Chen was ordered remanded further as the charge against him has no provision for bail.

The prosecution informed the court that about 18 witnesses would be called during the hearing.

Deputy Public Prosecutor  Nurliana Md Zukri appeared for the prosecution while Chew was represented by counsel Ram Singh and Kimberly Ye.
