Dad charged with raping daughter in Beaufort

Kota Kinabalu: A 39-year-old man was charged with raping his daughter.

The man was brought before Sessions Court Judge Azreena Aziz to face the charge against him on Friday.

No plea was recorded after the charge was read.

He is accused of raping the 13-year-old between July 2020 and Feb 3, this year at a house in Beaufort.

The offence, under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes of the cane, on conviction.

The court set March 23 for mention pending the medical and DNA reports pertaining to the case.

Pending the date, the man was ordered remanded further.

Deputy Public Prosecutor Nureen Natasha Mohd Raffie conducted the prosecution while the man was not represented.

On Thursday, a 54-year-old man who raped his 13-year-old daughter, was ordered to spend 20 years in jail and to get 15 strokes of the cane.

Sessions Court Judge Elsie Primus handed the sentence to the man after he pleaded guilty to the charge against him on Thursday.

The man had raped the girl at 2am on Dec 5, 2020 at a house in Kudat.

In another case, a 45-year-old teacher was freed from a charge of asking a nine-year-old pupil to perform oral sex on him.

Sessions Court Judge Marlina Ibrahim discharged and acquitted Abd Wahab Ibrahim, after ruling that the prosecution had failed to prove its case beyond reasonable doubt against Abd Wahab.

Abd Wahab was accused of committing the offence at 7am on March 7, 2017 at a room in a school in Keningau.

The offence under Section 377C of the Penal Code carries a jail term of between five and 20 years, and whipping, on conviction.

The prosecution had called 14 witnesses while only one defence witness was called in the hearing.

Deputy Public Prosecutor Nur Syafiqah Suleiman conducted the prosecution while counsel Hamid Ismail represented Abd Wahab.

Meanwhile, a 37-year-old woman was jailed seven years for taking syabu for the sixth time.

Pilia Askalani admitted before Sessions Court Judge Ummu Khaltom Abd Samad, to taking the drug repeatedly.

Pilia has five convictions record for taking the drug.

After completing her jail sentence, Pilia was ordered to be placed under supervision of police and National Anti-Drug Agency for three years.
