Typist cheating case adjourned to March 11

Kota Kinabalu: The Magistrate’s Court adjourned to March 11 for the case of a 35-year-old typist, who was charged with cheating 127 people of RM5,334 over purported letters addressed to a former Deputy Home Minister to support their application to obtain “entry permit’ and to convert IMM13 documents to MyPR.

Magistrate Jessica Ombou Kakayun fixed the date for Rohani Mohd Ismail, who was absent during the pre-trial case management of her case on Thursday.

Rohani as well as her counsel was not present in court when Rohani’s name was called on Thursday’s proceedings.

Jessica said that the court would take the case to one date, adding that, the court would issue an arrest warrant should the accused, her counsel as well as the investigations paper (IP) were not present.

In setting March 11 for mention of the case, the court also reminded the prosecution to ensure that the investigations paper of the case is around on that date.

Rohani allegedly committed the offence at 2.30pm on Nov 22, 2018 at the Areney Enterprise, Jalan Haji Yaakob in Kg Air here.

The charge stated that Rohani allegedly typed 127 letters addressed to former Deputy Home Minister Datuk Azis Jamman to apply for support to approve entry permit registrations and MyPR cards.

The charge also stated that Rohani allegedly deceived the victims by making them to believe that such application letter could convert IMM13 document to MyPR, which induced the alleged victims to pay her RM42 for each application.

According to the charge, Rohani allegedly obtained a total of RM5,334 from the 127 people that day.

The charge under Section 420 of the Penal Code provides for a jail term of between one and 10 years, and whipping and fine, upon conviction.

 Rohani was first charged with the offence on April 17, 2019 before another Magistrate’s Court where she had claimed trial.

On May 15, 2019, during case management, Rohani was given a discharge not amounting to an acquittal (DNAA) by the court as the documents for trial were not prepared.

On June 11, 2019, Rohani was recharged in the Magistrate’s Court with the same charge in which she pleaded not guilty and has since released on a bail of RM2,000 in two sureties. Rohani was represented by counsel Farazwin Haxdy.

In another case, a 21-year-old man was fined RM1,300 or five months jail for taking drugs.

Yong Chun Chin pleaded guilty to committing the offence under Section 15(1)(a) of the Dangerous Drugs Act 1952 which provides for a fine of up to RM5,000 or up to two years jail on conviction.

Earlier, counsel PJ Perira representing Yong applied for a lenient sentence as it was his first offence and that he is currently working in Johor Bahru.

The court ordered Yong to be placed under police supervision for two years. Inspector Albert Basiri prosecuted.
