Kota Kinabalu: A 58-year-old man who raped an 11-year-old girl, was sentenced to 25 years’ jail and ordered given a stroke of the cane.
Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to Aliamat Dullah, after ruling that the prosecution had proven its case beyond reasonable doubt against Aliamat.
Aliamat was found guilty of raping the girl at 1pm in May 2018 at a house in Papar.
He was convicted under Section 376(2)(e) of the Penal Code which carries a jail term of between 10 and 30 years, and whipping, on conviction.
In handing down the sentence, the court had considered the aggravating factors, outweighted mitigating factors in this case, seriousness of the offence, age of the victim and effect of the incident to the victim.
About 12 witnesses from the prosecution were called while the defence had called several witnesses during the hearing.
The court ordered Aliamat to serve the jail sentence from the date of his arrest on July 25, 2019.
Deputy Public Prosecutor Nur Faezah Jafry conducted the prosecution while counsel Shahlan Jufri defended Aliamat.
