Duo get nine months jail each for stealing onions, garlic

Kota Kinabalu: Two men were each given nine months jail for stealing seven sacks of red onions and garlic from a shop, two months ago.

Mohd Elmay Emlani, 21, and Absrin Abraham, 29, pleaded guilty before Magistrate Lovely Natasha Charles on Monday to stealing four sacks of red onions and three sacks of garlic at the Pick N Pay shop at Taman Tuan Huat here at 1.15pm on Jan 29, this year.

Inspector Kelvan Elson Maik, prosecuting, told the court that both Elmay and Absrin were arrested by police on Jan 31 following a report lodge of a theft at the said shop.

Both Elmay and Absrin admitted to stealing the onions from the said shop and sold them to a restaurant in Sinsuran for RM85.

They were charged under Section 380 of the Penal Code, which carries a jail term of up to 10 years and liability of a fine on conviction.

The court ordered the duo to serve the sentence from the date of their arrest.

In another case, four men were penalised for committing drugs related offences.

Three of them Aiman Hakimi, Sharif Almuhaimin and Charlie Ting admitted to taking syabu and amphetamine.

Aiman was jailed five months while Sharif was ordered to pay a fine of RM2,500 or six months jail and Ting was fined RM2,400 or six months jail.

Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction.

Meanwhile, Faizal Wira, 28, was jailed 13 months for having 0.06gm syabu on Dec 22, 2020 in Manggatal.

He was charged under Section 12 (2) of the Dangerous Drug Act 1952 which provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
