Kota Kinabalu: A 23-year-old Filipina who stayed in the State after her passport had been expired since three years ago, was sent to prison for four months.
Caprilia Nonilery pleaded guilty before Sessions Court Judge Azreena Aziz after the charge was read to him on Wednesday.
The court heard that Caprilia’s passport expired on Dec 9, 2018 but she continued to stay in the State.
The offence under Section 15 (1)(c) of the Immigration Act 1959/63 provides for a jail term of up to five years, or a fine of up to RM10,000, or both, on conviction.
After completing her jail sentence, Caprilia was ordered referred to the Immigration Department.
During mitigation, Caprilia asked for leniency saying that she has two children to look after.
However, Prosecuting Officer Inspector Suzie Kupit urged the court to impose an appropriate sentence.
In another court, a 28-year-old man was jailed five years and ordered to get a stroke of the cane for taking syabu repeatedly.
Muhummad Ikram Syafiq Lahaji admitted before Sessions Court Judge Noor Hafizah Mohd Salim.
He was found taking drugs at 8.40pm on Jan 8 this year after his urine tested positive for drugs at the police station here.
The court heard that Muhammad has two previous convictions for taking drugs.
Muhammad was ordered placed under police supervision for two years after serving the jail sentence.
