Kota Kinabalu: A 62-year-old man who caused grievous hurt to another man was jailed three years.
Sessions Court Judge Elsie Primus meted out the sentence to Sii Yii Dung who pleaded guilty.
Sii had assaulted Wong Huan Fong, 28, by using an iron rod at 10pm on March 17 this year at the compound of a house in Taman Ganang Kepayan, here.
He committed the offence under Section 326 of the Penal Code which provides for a jail term of up to 20 years, and liable to whipping, or fine, upon conviction.
The court ordered Sii to serve the jail sentence from the date of his arrest on March 20.
During mitigation, Sii who was not represented, asked for leniency saying that it was his first offence and that he is a diabetic and has heart problems.
According to Sii, he needed to consume 10 types of medicines.
He also informed the court that he was remorseful and promised not to repeat the offence.
Sii further said that he also needed to look after his elderly parents.
However, Deputy Public Prosecutor Rustam Sanip urged the court to impose a deterrent sentence on the grounds that the victim had suffered grievous injuries as Sii had used an iron rod during the incident.
Rustam submitted that due to the incident, the victim was hospitalised for three days and the doctor confirmed that there was fractured on the victim’s left hand.
