Kota Kinabalu: A 56-year-old project broker was sentenced to 24 months jail and fined RM6,000 or 12 months jail by the Magistrate’s Court on Monday after he was found guilty of cheating a woman of over RM50,000 housing development project.
Chin Swee Fah was found guilty of cheating one Norlihan Mohd Azman by making her to believe that he could make a land rezoning paperwork for housing development in Kota Marudu which induced the complainant to give RM50,000 to him.
The offence took place at 12 noon between Feb 27, 2017 and March 20 the same year at Runaway Café in Tanjung Aru.
The charge under Section 420 of the Penal Code provides for a jail term of between one and 10 years, and whipping and fine, on conviction.
Magistrate Jessica Ombou ordered Chin to serve the imprisonment sentence from the date of his conviction.
However, Chin, who was on bail, managed to obtain a stay pending an appeal to the High Court against the Magistrate’s decision.
Prosecuting officer Inspector Albert Basiri called five witnesses at the prosecution stage while the defence, two witnesses.
