Man ordered to enter defence for raping daughter in Kota Belud

Kota Kinabalu: A 55-year-old farmer charged with raping his 16-year-old daughter in Kota Belud was ordered to enter his defence to the charge.Sessions Court Judge Elsie Primus made the order on Wednesday ruling that the court satisfied that the prosecution had proved a prima facie case against the man.

Elsie set June 11 and June 29 for the man’s defence.
The man was accused of committing the crime between February 2019 and April the same year in a car at a roadside of a village in Kota Belud.
He had on May 22, 2019 claimed trial to the charge under Section 376(3) of the Penal Code which carries a jail term of between eight years and 30 years and whipping not less than 10 times, upon conviction.
Counsel Luke Ressa Balang said the defence would be calling four witnesses.

The prosecution had called five witnesses to testify at the prosecution stage.
Pending the date, the man was ordered to be remanded further. Deputy Public Prosecutor Mas Izzaty Lokman prosecuted.

Magistrate Lovely Natasha Charles ordered Malron Mano to serve the sentence after he pleaded guilty to committing the offence here on Aug 10, 2020.
Malron was charged under Section 12 (2) of the Dangerous Drugs Act 1952 which provides for a fine of up to RM100,000 or up to five years jail or both, upon conviction. Inspector Kelvan Elson Maik prosecuted.
