Fined for running entertainment outlet with no licence

Kota Kinabalu: A caretaker of an entertainment outlet was fined RM1,800 or two months jail on Monday for operating it without a licence last year.

Abdul Malek Dan, 31, pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence at Golden City KTV Club Sdn Bhd, Block A, Pintas Avenue shop in Penampang at 10.30pm on Nov 28, 2020.

The facts of the case presented by the prosecution stated that Malek, who was the caretaker of the outlet failed to produce a business licence to police who inspected the premises.

Investigations revealed that the Penampang District Council informed the police that the premises was still under the attention of the Fire and Rescue Department to request comments in support of licensing for the business activity applied for, namely karaoke KTV room.

Malek was charged under Section 3 of the Public Entertainment Ordinance 1958 which provides for a fine of up to RM50,000 or up to one year jail or both on conviction.

In another case, a 49-year-old man was ordered to pay a fine of RM100 or three days jail for fraudulently having RM3,350 in his bank account.

Sikong Dalansu admitted to having the money which was credited into his account on Dec 31, 2020 and that he failed to account satisfactorily on how he obtained the money.

Sikong was charged under Section 22A (1) of the Minor Offences Ordinance, which provides for a fine of up to RM100 or up to three months jail or both on conviction.

Meanwhile, a 21-year-old man was charged with theft.

Mohd Hiesyamuddin Baharudding claimed trial before Magistrate Lovely Natasha Charles to stealing a ring belonging to one Ellanabilah Miris at 12am on April 18, this year at the Emergency and Trauma Department in Queen Elizabeth Hospital II.

He was charged under Section 379 of the Penal Code, which carries a jail term of up to seven years or fine on conviction.

The court set May 24 for pre-trial case management and released Hiesyamuddin on a bail of RM1,000 in two sureties.

Inspectors Albert Basiri and Kelvan Elson Maik prosecuted.
