Kota Kinabalu: A 36-year-old rubber tapper was sentenced to 12 months’ jail on Tuesday for damaging the windscreen and rear window of a vehicle that belonged to his relative.
Tony Iting pleaded guilty before Magistrate Stephanie Sherron Abbie to committing mischief to the property belonging to one Judy Benedict at 10.10am on April 27, this year at Kg Pulutan in Manggatal.
Inspector Suzie @ Stephanie Kupit prosecuting, informed the court that Judy lodged a police report after she was informed by her sister of the incident in front of a house in the said village.
Judy’s nephew and uncle witnessed the incident where Tony, who was their relative, threw a brick to the windscreen of Judy’s vehicle and also used the same brick to smash the vehicle’s rear window, the court heard. Tony was arrested by police at 3.30pm on the same day and investigations revealed that there was no problem between Tony and the vehicle owner, said the prosecution.
Duty counsel Lim Ming Zoong @ Lawrence, representing Tony, requested for a lenient sentence on the grounds that he did not earn much from his work as a rubber tapper.
Tony was charged under Section 427 of the Penal Code, which carries a jail term of between one year and five years or fine, or both on conviction.
He was ordered to serve the sentence from the date of his arrest.
In another case, a 27-year-old man was jailed six months for theft.
Jafri Nasri admitted to stealing cables belonging to Telekom Malaysia Berhad at 5.35am on March 5 at a roadside of Jalan Tongkuzu, Kolombong.
The court heard that a security guard of a showroom near the said place saw an unknown man cutting the cable outside of the fence of his working place and immediately contacted the police.
The man, later identified as Jafri, was arrested by the police who also seized a roll of Telekom cables from him.
Jafri confessed to stealing the cables as he wanted to sell them to purchase drugs.
Jafri through duty counsel Lim, requested for a lenient sentence by saying that he is taking care of his parents.
He was charged under Section 379 of the Penal Code, which carries a jail term of up to seven years or fine, or both on conviction.
