Kota Kinabalu: A 39-year-old Vietnamese was charged with failing to notify the authorised officer while being on Malaysian waters.
Nguyen Huu Tri pleaded not guilty before Sessions Court Judge Egusra Ali to the charge against him, Wednesday.
He failed to notify the officer through radio, telex or facsimile in English or Malay language about their names, country flag, location, vessel’s destination as well as types and amount fish they carried while on Malaysian waters.
Nguyen committed the offence at 4.40am on April 11 this year inside a foreign vessel with the registration TG 72972 at Pulau Labuan.
The offence under Section 16(3) of the Fisheries Act and punishable under Section 25(a) of the same Act which provides for a fine of up to RM6 million for a skipper, and RM600,000 for each crew of the vessel, upon conviction.
The court set June 10 for case management and ordered Nguyen to be remanded further pending the date.
Meanwhile, Nguyen together with another four Vietnamese also claimed trial to entering the State illegally.
The four were Danh Minh, 24, Le Cuc Xiep, 35, Le Tharih Phuong, 37, and Vo Hoang Nam, 43.
They were arrested on the same day with Nguyen without any identification documents.
The court fixed June 15 for hearing their case.
Deputy Public Prosecutor Nurun Nazifah Muhammad Iyen from the Malaysia Maritime Enforcement appeared for the prosecution while counsel Rakhbir Singh defended the Vietnamese.
