Duo penalised for having illegal gambling items
Kota Kinabalu: Two men were penalised by the Magistrate’s Court here Thursday for having illegal gambling paraphernalia.

Jobless Musa Osman, 45, and waiter Vincent Hee, 39, pleaded guilty separately before Magistrate Lovely Natasha Charles to committing the offence.

Musa was sentenced to two months’ jail for having the items including one lottery ticket, a handphone and RM100 in cash at 4.45pm on Dec 14, 2019 in front of a restaurant in Donggongon, Penampang.

Musa, currently serving jail term on four other offences, was ordered to serve the sentence consecutively.

Hee was fined RM900 or two months jail for having four pieces of lottery tickets, a mobile printer, a handphone and RM90 in cash at 4.30pm on Aug 8, 2020 in a coffee shop at Taman Putatan Baru, Penampang.

They were each charged under Section 9(1) of the Common Gaming House Act carries a jail term of up to six months, or fine of up to RM3,000, or both, on conviction.

Earlier, the prosecution in presenting the facts of Musa’s and Hee’s case, said the police inspected the said areas following information on the sale of 4D tickets without licence. Duty counsel Lim Ming Zoong @ Lawrence representing both Musa and Hee, requested for a lenient sentence on the grounds that they have family members to support.

Meanwhile, a 20-year-old Filipina was charged with engaging in online gambling using a handphone in public.

Karmina was accused of committing the offence at 7.05pm on May 8 this year, at a café in Asia City.

No plea was taken from Karmina, who was at the central lockup, Kepayan, after the charge was read to her via video conferencing.

Her plea would only be recorded when she is brought to court.

The prosecution applied for a further mention date and objected bail as Karmina has no identification document.

Magistrate Stephanie Sherron Abbie set May 24 for mention and ordered the accused be remanded further.

Karmina was charged under Section 7(2) of the same Act, which each provides for a fine of up to RM5,000 or up to six months jail or both on conviction.

In another case, a man claimed trial for causing damages to a door of a house in Manggatal.

Md Jumat Brahim, who was brought before Magistrate Stephanie, was accused of committing mischief to the property belonging to one Musnah Wara at 4.30pm on April 15.

The court fixed June 2 for case management and ordered Jumat be further remanded.

The charge under Section 427 of the Penal Code carries a jail term of between one year and five years or with fine or with both, on conviction.
