Kota Kinabalu: The Magistrate’s Court, Wednesday, fined a man RM1,500 or five months jail for having fake identification document.
Senior Assistant Registrar Tiong Wen Wen, who sat as magistrate, meted out the sentence to Michael Lou Alixcius after he pleaded guilty to having the MyKad under his name as his identification document at 1.30pm on Dec 16 last year at the Penampang National Registration Department (NRD).
The charge under Section 25(1)(e) of the National Registration Regulations 1990 (Amended 2007) carries a jail term of up to three years or fine up to RM20,000 or both, on conviction.
Earlier, prosecuting officer from the NRD, Mohd Naser Mohd Nadzeri informed the court that Michael, who came to the Penampang NRD, was arrested on suspicion of having a fake identification document under his name.
Mohd Naser said a check on Michael’s thumbprints found that there were not in NRD’s records.
Further check by the Identity Card division of the State NRD found that the identity card had never been issued, the court heard. Counsel Batholomew Jinggulam, representing Michael, requested for a lower fine.
In another case, a 32-year-old man was sentenced to six months jail for having housebreaking tools.
Nasir Ali admitted to having the items, an adjustable wrench, three units of wire cutters, a hammer, torchlight, knife and screwdriver at 6pm on Dec 19 at a security guard kiosk of GHK building, Jalan Punai Tanah, Likas.
Inspector Kumar Vijayan, prosecuting, told the court that the tools were found in Nasir’s possession when he was arrested by police.
Nasir had committed an offence under Section 18 of the Minor Offences Ordinance which provides for a jail term of up to six months.
