Kota Kinabalu: A 33-year-old man was jailed 36 months for setting a house ablaze.
Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence on Mohd Shahrizal Jadi who pleaded guilty to an alternative charge offered by the prosecution.
Mohd Sharizal is accused of committing the mischief at 11.30pm on Sept 11, 2020 in Kg Sungai Damit in Tuaran.
The alternative charge falls under Section 426 of the Penal Code which carries a jail term of up five years, or a fine, or both, on conviction.
Mohd Sharizal was ordered to serve the jail sentence from the date of his arrest at the Kepayan Central Prison, here.
Meanwhile, Mohd Shahrizal was given discharged not amounting to an acquittal from the main charge under Section 436 of the Penal Code which provides for a jail term of up to 20 years, and liable to a fine, on conviction.
The court heard that when the complainant of the case returned to her house in Tuaran, she found there were burn marks on the wooden planks of her house.
The complainant then asked her neighbour who told her that she saw Mohd Shahrizal pouring petrol on the house’s wooden stairs and set fire.
Following a police report lodged by the complainant, Mohd Shahrizal was arrested on Sept 15, 2020.
Meanwhile, in another case, a man was charged with taking drugs for the seventh time.
However, no plea was recorded from Ranwill Mojilin pending the chemist’s report.
The court set Feb 14 for mention and no bail was offered to Ranwill who allegedly has six previous convictions for taking drugs.
